The Illinois Supreme Court has again decided that caps on damages are unconstitutional. Before and since the legislation was enacted much has been written about the "crisis", some of which has been a complete fabrication. The Illinois Trial Lawyers Association, of which I am a member, has produced an excellent paper examining some of the lies, exaggerations and myths about the medical malpractice "crisis". While few Drs will acknowledge it they have ITLA's efforts to thank for the reduced premiums they are now paying. Those reductions have nothing to do with damage caps, which few if any lawyers (including defense lawyers) thought would survive constitutional scrutiny. Rather, the reductions have everything to do with ITLA and the state's forcing the the Dr's own insurance company to open its books. Now that they are open other insurance companies are writing business in IL and the law of supply and demand has caused premiums to come down -- which is good news for doctors and the patients they serve.
